DSAG: Contract remains a contract

According to recent media reports, SAP wants to claim user licensing based on SAP authorizations, which could potentially result in drastic additional payments for customers.

DSAG: Contract remains a contract

The most important point, which in our view creates a certain amount of uncertainty, relates to existing contracts. A concluded contract remains a contract and cannot be changed unilaterally in retrospect.

If, for example, in the existing contract the user numbers are licensed according to real usage, which was common in the past, and not according to authorizations, then this is valid and will also apply to these licenses in the future.

If licensing based on authorizations is actually planned in this way in the future, we as DSAG will naturally question SAP at this point.

We expect SAP to respect the existing contracts and, in accordance with these contracts, to measure (audit) the systems and fulfill its obligations.

In addition, one must certainly question whether a measurement model according to authorizations makes any sense at all. Because then the prerequisite for any SAP contract would be that you develop and permanently maintain a complete, granular authorization concept for your SAP applications.

And this may also be associated with corresponding costs. Or should the elimination or modification of authorization objects by SAP result in a license obligation for the customer?

How SAP wanted to handle its own transactions, customizations or partner solutions beyond that, according to recent media reports, seems questionable to say the least.

For the majority of the numerous customers with old and new contracts, the situation would no longer be ascertainable. We will continue to monitor the situation critically for our members.
